וְדַע דְּאִסוּר רְכִילוּת הוּא אֲפִלּוּ עַל עַם הָאָרֶץ, כִּי גַּם הוּא בִּכְלַל עַמֶּיךָ. וְאַף שֶׁהוּא רוֹאֶה בְּבֵרוּר, שֶׁעַם הָאָרֶץ זֶה גִּנָּה לְאֶחָד שֶׁלֹּא בְּפָנָיו עַל חִנָּם, וְהַדִּין הוּא עִם אוֹתוֹ פְּלוֹנִי, אַף עַל פִּי כֵן הֲלֹא בֵּרַרְנוּ לְעֵיל בִּכְלָל א', דְּאִסוּר רְכִילוּת הוּא אֲפִלּוּ עַל אֱמֶת. וְכָל שֶׁכֵּן לְסַפֵּר רְכִילוּת עַל תַּלְמִיד חָכָם, הֶעָוֹן יוֹתֵר גָּדוֹל וְיוֹתֵר עָצוּם מִפְּנִי כַּמָּה טְעָמִים:
And know that the issur of rechiluth obtains even [if spoken] against an am ha'aretz [(ignoramus)], he, too, being in the category of "your people." And even if one sees clearly that this am ha'aretz demeaned someone, not to his face, in vain, and that the din is with the other, still, have we not explained above (Principle I) that the issur of rechiluth obtains even if spoken truthfully? How much greater and more severe is the sin of speaking rechiluth against a Torah scholar, for several reasons:
И знай, что запрет рехилут действует даже в отношении простого человека (ам а-арец), ибо и он входит в понятие «в народе твоём». И даже если он видит ясно, что этот простой человек порочил кого-то за его спиной напрасно, и закон на стороне того другого — тем не менее ведь мы разъяснили выше, в правиле 1, что запрет рехилут действует даже о правде. И тем более рассказывать рехилут о знатоке Торы (талмид хахам) — грех значительно больше и тяжелее по нескольким причинам:
א מִצַּד עֶצֶּם הָרְכִילוּת, דַּהֲלֹא פָּשׁוּט הוּא, שֶׁאִם בִּרְכִילוּת, שֶׁסִפֵּר עַל חֲבֵרוֹ, הָיְתָה תַּעֲרובֶת שֶׁקִָּר, בְּוַדַּאי עָנְשׁוֹ חָמוּר יוֹתֵר, מִשֶּׁאִם הָיָה אֱמֶת, וְכַאֲשֶׁר נְדַיֵּק בְּעִנְיָנֵנוּ, יִמָּצִא עַל פִּי הָרוֹב, שֶׁהִיא רְכִילוּת שֶׁל שֶׁקֶּר, כִּי תַּלְמִיד חָכָם מִסְּתָמָא אֵינוֹ מְגַנְּה וְאֵינוֹ עוֹשֶׂה רָעָה לְאָדָם בְּחִנָּם, וְיֵשׁ לָנוּ לִתְלוֹת שֶׁכַּדִּין עָשָׂה מַה שֶּׁעָשָׂה, עַל כֵּן, הַהוֹלֵךְ וּמְסַפֵּר עָלָיו דָּבָר זֶה לְעַוְלָה, הוּא רְכִילוּת שֶׁל שֶׁקֶר.
a) because of the rechiluth itself. For is it not obvious that even if in the rechiluth that he spoke against his friend there were an admixture of falsehood, certainly his punishment is more severe than if it were [completely] true? And if we look into our instance, it will be found, in most cases to be a rechiluth of falsehood. For a Torah scholar — it may be assumed — does not demean or do wrong to a man in vain; and it may be assumed that what he did, he did according to the din. Therefore, if one goes and speaks of him as having done something wrong, that is a rechiluth of falsehood.
1. Со стороны самой рехилут: ведь очевидно, что если в рехилут, которую он рассказал о ближнем, была примесь лжи — безусловно его наказание тяжелее, чем если бы это была правда. И если мы вдумаемся в наш случай, обнаружится, что в большинстве случаев это рехилут лживая, ибо знаток Торы предположител��но не порочит и не причиняет зла человеку напрасно, и мы должны полагать, что он поступил по закону. Поэтому тот, кто идёт и рассказывает об этом как о несправедливости — это лживая рехилут.
ב מִצַּד עַצְמִיּוּת הָאִישׁ הַהוּא, שֶׁהֲרֵי צִוְּתָה לָנוּ הַתּוֹרָה לְהִתְדַּבֵּק בָּהֶם בְּכָל מִינִי חִבּוּר, לֶאֱכֹל וְלִשְׁתּוֹת וְלַעֲשׂוֹת פְּרַקְמַטְיָא עִם תַּלְמִיד חָכָם וּלְהַשִּׂיא בִּתּוֹ לְתַלְמִיד חָכָם וְלִנְהֹג בָּהֶן כָּבוֹד הַרְבֵּה, וְעַל אַחַת כַּמָּה וְכַמָּה שֶׁלֹּא לְעוֹרֵר מְדָנִים עָלָיו, שֶׁדָּבָר זֶה גּוֹרֵם הִפּוּךְ כָּל הַנַּ"ל.
b) because of the very nature of that man [the Torah scholar]. For the Torah has commanded us to cleave to them [Torah scholars] in all connections: to eat and drink and do business with a Torah scholar, and to marry his daughter to a Torah scholar, and to honor them greatly. How much more so is it forbidden to stir up strife with them. For this leads to the opposite of all these.

Со стороны самой сущности того человека: ведь Тора заповедала нам прилепляться к ним всякими видами связи — есть и пить и вести дела с знатоком Торы, и выдавать дочь за знатока Торы, и оказывать им великий почёт. И тем более не возбуждать против него раздоры, ибо это являетс�� противоположностью всему вышесказанному.
ג מִצַּד הַסִבָּה הַצּוֹמַחַת מִסִפּוּרוֹ, כִּי יָדוּעַ הוּא שֶׁלֹּא יִתְפַּעֵל אָדָם כָּל כָּךְ, כְּשֶׁאֶחָד מֵעַם הָאָרֶץ גִּנָּה אוֹתוֹ, אוֹ עָשָׂה לוֹ שׁוּם דְּבַר עַוְלָה, אֲבָל אִם יְסַפֵּר לוֹ אֶחָד, שֶׁתַּלְמִיד חָכָם גִּנָּה אוֹתוֹ, בְּוַדַּאי יוֹתֵר תִּכָּנֵס שִׂנְאָה בְּלִבּוֹ עָלָיו, וְרָגִיל מְאֹד לְהִתְעוֹרֵר מְדָנִים עַל יְדֵי זֶה, וּבִפְרָט אִם מְסַפֵּר עַל הָרַב שֶׁבָּעִיר, בְּוַדַּאי רָגִיל לָבוֹא עַל יְדֵי זֶה קִלְקוּלִים גְּדוֹלִים עַד מְאֹד, וְכַמָּה פְּעָמִים יוֹרֵד עִמּוֹ לְחַיָּיו מַמָּשׁ עַל יְדֵי זֶה.
c) because of what results from this tale. For it is well known that one is not so greatly affected if an am ha'aretz demeans him or does him some wrong. But if one is told that a Torah scholar demeaned him, certainly more hatred will enter his heart against him, and it is very likely that strife will be stirred up because of this. And especially if he speaks against the Rabbi of the city, great harm can result from this, and quite often his very livelihood is endangered because of this.
3. Со стороны последствий, произрастающих из его рассказа: ибо известно, что человек не будет столь задет, когда один из простых людей опорочит его или причинит ему несправедливость. Но если кто-то расскажет ему, что знаток Торы опорочил его — безусловно, в его сердце войдёт гораздо большая ненависть, и весьма часто из-за этого возбуждаются раздоры. И тем более если рассказывают о раввине города — безусловно из-за этого обычно происходят весьма великие бедствия, и нередко из-за этого буквально сживают его со света.
