לא תענה מכלל מצות לא תעשה אסור לומר דבר מגונה מחבירו שלא בפניו כל דבר שאם היה שומע אותו היה כועס עליו. דכתיב (תהלים נ כ) תשב באחיך תדבר בבן אמך תתן דופי אבל אם עבר עבירות והוכיחו בסתר ולא קיבל אז מותר להוכיחו ברבים במעשיו הרעים בין בפניו בין שלא בפניו:
“Thou shalt not bear false witness against thy neighbor” (Exod. 20:13). By implication of this negative command it is forbidden to say a shameful thing about a neighbor not in his presence, i.e., that if he were to hear it, it would anger him.1Arakhin 15b. As it is written, “Thou sittest and speakest against thy brother, thou slanderest thine own mother’s son” (Ps. 50:20).But if he has committed sins and has been reproved privately but he has not accepted (the reproofs) then it is permissible to reprimand him publicly for his evil doings, with or without his presence.2Maimonides, Hilkhoth Deoth, 6:8.
«Не отвечай» — из запретительных заповедей запрещено говорить дурное о ближнем своём не в его присутствии — всякое слово, которое если бы тот услышал, то разгневался бы. Как написано: «Сидишь, на брата своего говоришь, на сына матери своей возводишь хулу» (Теилим 50:20). Однако если совершил грехи, и его увещевали втайне, и он не принял — тогда дозволено увещевать его прилюдно за его дурные дела, как в его присутствии, так и в его отсутствие.
